Terms of Service

These Terms of Service ("Terms") govern access to and use of Aktimus, an AI platform that helps businesses manage customer communication over WhatsApp, operated by LABOUTI, S.A. de C.V. ("Aktimus", "we", "us"). By creating an account or using Aktimus, a business ("Tenant") agrees to these Terms.
The service
Aktimus lets a Tenant connect a WhatsApp Business phone number so that messages from its customers can be received, routed, and, where enabled, responded to with AI-assisted drafts. Aktimus is a technology provider that facilitates this communication; it does not control what a Tenant's business does or the substance of a Tenant's communications with its own customers.
Accounts and eligibility
A Tenant must provide accurate information when setting up an account and is responsible for activity that occurs under its account, including for any team members it authorizes to access it.
Acceptable use
- A Tenant must comply with WhatsApp's Business Messaging Policy and Meta's platform terms when using a number connected through Aktimus.
- A Tenant may not use Aktimus to send unsolicited bulk messages, spam, or content that violates applicable law.
- A Tenant is responsible for having a lawful basis to message the individuals it contacts through Aktimus, and for honoring opt-out and other requests from its own customers.
- A Tenant may not use Aktimus in a way that attempts to circumvent WhatsApp's or Meta's policies, rate limits, or security controls.
AI-assisted responses
Where a Tenant enables AI-assisted drafting, Aktimus may propose message content based on the conversation. AI-generated content can be inaccurate or unsuitable in some situations. A Tenant remains responsible for reviewing and, where our workflow requires it, approving messages before they are sent to its customers under its business's name.
Fees
Aktimus is currently offered under early trial arrangements while pricing and billing terms are finalized. Any applicable fees for continued or expanded use will be communicated to a Tenant before they take effect.
Data and privacy
Our handling of personal data is described in our Privacy Policy, which forms part of these Terms.
Suspension and termination
We may suspend or terminate access to Aktimus if a Tenant violates these Terms, WhatsApp's Business Messaging Policy, or applicable law, or where required to protect the security or integrity of the service. A Tenant may stop using Aktimus and request deletion of its account at any time — see our Data Deletion Instructions.
Disclaimers
Aktimus is provided on an "as is" and "as available" basis while in early development, without warranties of any kind, express or implied, including as to availability, accuracy, or fitness for a particular purpose.
Limitation of liability
To the maximum extent permitted by law, Aktimus and LABOUTI, S.A. de C.V. will not be liable for indirect, incidental, or consequential damages arising from use of the service. This section, like the rest of these Terms, is subject to revision once reviewed by legal counsel.
Governing law
These Terms are governed by the laws of Mexico, without regard to conflict-of-law principles.
Changes to these Terms
We may update these Terms as Aktimus develops and as they are reviewed by legal counsel. We will update the "Last updated" date above when we do.
